Practice Emphasis:

Bill practices civil litigation out of the Salt Lake City Vial Fotheringham Office, emphasizing in complex construction defect litigation. In his 26 years of practice, Bill has tried and resolved a broad spectrum of civil disputes including product and premises liability defense, employment and civil rights, partnership disputes, land use and zoning issues, water rights disputes, general homeowners association disputes, and construction defect cases.

Professional Experience:

Prior to joining Vial Fotheringham, Bill was the senior litigation attorney for one of Salt Lake City’s oldest law firms (out of its St. George office). Bill has achieved excellent results in representing both municipalities and private land owners in complex land use/zoning cases, including adverse condemnation and taking claims. He has been actively involved with municipal land planning and enforcement of land use ordinances and covenants, both as a volunteer on municipal planning committees and as an administrative law judge handling zoning and land use disputes. Bill recently achieved excellent results for homeowner groups in both the trial and negotiation settings involving a rural homeowners association’s right to control water rights and in construction defect issues. Bill believes that detailed investigation and preparation [coupled with actual trial experience] provide the most effective foundation for successful resolution of litigation disputes; he is committed to providing Vial Fotheringham clients just that kind of representation
